Happy Halloween "Love Witch" Story
"Love witch" loses court battle
BERLIN (Reuters) - A German woman won a lawsuit against a "love witch" who failed to induce her ex-boyfriend to come back with rituals under the full moon designed to cast a spell over him, a Munich court said Monday.
"The witch lost," said Munich district court spokeswoman Ingrid Kaps. The 'love witch' was ordered to return her 1,000 euro ($1,300) fee and pay "several hundred euros" in costs.
"The plaintiff was in despair after her boyfriend left and tried to get him to return with help from a woman who calls herself a 'love witch'," she added. "The court has ruled it was a service that was 'objectively impossible' to render."
The witch disputed the plaintiff's claim of a money-back guarantee, Kaps said. The witch, described as an elderly woman, also lost an appeal. The spokeswoman declined to give the names or ages of those involved.
"A love ritual is not suited to influence a person from long distance," the court said. "As the promised service could not be rendered, the plaintiff is not obligated to pay."
Okay, there you have it! A "Love Witch" is NOT going to get your significant other back! For the reason the story points out. However, way back when, I did go out with a "white witch", which for those of you that do not know, is a good witch. And even though she could not perform the above service, there was stuff that she could and did do. How, I have no idea. All I know is that there is more going on in this world and place than the majority of you would want to, or, need to know. Trust me!

NFL Picks Wk 8 by Bobby
Okay, here we are at Wk 8 of the 2006 NFL season. Last week was an improvement over the previous week, but, it was still not typical. We were 6-7 last week. For the season so far, we are 66-35 straight up and 53-48 against the spread. Lets see what we can bag this week.

Video Game News Update
Video-Game News in Brief
_SONY'S STRATEGY: There are still a lot of questions surrounding the Nov. 17 launch of the PlayStation 3 - in particular, just how many people will be able to buy one. But Sony's PR engine is proceeding as though the PS3's production issues are nonexistent, and the company hosted a "Gamers' Day" in San Francisco to build the hype. Sony emphasized the PS3's online PlayStation Store, which will allow users to download arcade games, demos and bonus content for store-bought titles - stuff that's been available on Microsoft's Xbox Live for a while now. Sony also demonstrated its motion-detecting Sixaxis controller, showing how you would tilt and jerk the device to control a dragon in the forthcoming medieval fantasy "Lair." And it was announced that the first 500,000 PS3 buyers will get a free Blu-ray DVD of "Talladega Nights" - reason enough to consider buying the Nintendo Wii instead.
_RESISTANCE NOT FUTILE: Still, the list of PS3 games scheduled for the holidays isn't bad, especially if you're just looking for higher-definition versions of familiar franchises. The usual suspects include "Madden NFL 07,""Tiger Woods PGA Tour 07,""Tom Clancy's Rainbow Six: Vegas,""Ridge Racer 7" and "Tony Hawk's Project 8." The real standouts among the 21 launch titles - the games you'll have to get a PS3 to play - are "Resistance: Fall of Man," a sci-fi war game from "Ratchet & Clank" developer Insomniac Games, and "Genji: Days of the Blade," an adventure set in feudal China. Perhaps more intriguing is one of Sony's downloadable titles, a goofy car-chase party game called "Criminal Crackdown" from "God of War" creator (and "Twisted Metal" vet) David Jaffe.
_SCIENCE FAIR: A good game - say, "Okami" or "Xenosaga III" - requires all sorts of mental gymnastics, from strategic thinking to adaptation to rapid change. At least that's how the Federation of American Scientists, which normally deals with such weighty topics as nuclear proliferation, sees it. The group called on the federal government to look for ways to create games that can be used as learning tools. Federation president Henry Kelly urged the Labor and Education departments to work with the National Science Foundation to determine which video-game skills are most important to learning, and then work to develop software that improves those skills. "This is the kind of thing where the federal government has always acted in the past," Kelly said.
_RATINGS BOOK: Nielsen Media Research, the company that compiles TV ratings, knows why fewer young people are watching prime-time programming: We're too busy playing video games. So the company has announced it's going to start tracking the amount of time we spend with joysticks in our hands. The new data should lead the way to more advertising in games; if a company finds out you're playing "Madden NFL" for 20 hours a week, it will want to spend money to put an ad there. "The value of an entertainment medium is directly proportional to how well it is measured," said Nielsen vice president Jeff Herrmann. Funny, all this time we thought the value of an entertainment medium was in how entertaining it was.
_ACTION JACKSON: Peter Jackson, who defied all Hollywood expectations by bringing "The Lord of the Rings" to the silver screen, may have a tougher challenge on his hands: delivering the first blockbuster video-game movie. When Jackson signed on to produce the film version of "Halo," the project looked unstoppable - until co-financers Universal and Fox abruptly backed out. Variety reported rumors of an out-of-control budget, but a representative for Jackson and his partner, Fran Walsh, told the Hollywood trade paper that the studios had demanded a pay cut for the filmmakers at the last minute. Microsoft issued a statement saying, "We are disappointed that Universal and Fox wanted to significantly renegotiate the financial points of the deal," but added that Jackson, Walsh and "the rest of the creative team are dedicated to ensuring the Halo movie becomes a reality."
The holidays are coming and video gaming is the ticket. Not too mention the fact that video games are a bigger business than pretty much any other form of entertainment.

Web Gambling, Poker & The Idiot Government
New Law on Web Gambling May Hurt Poker
LAS VEGAS (AP) - Observers say the recently enacted U.S. law that bans gambling online could cut into the number of entrants to the planet's richest card game - the World Series of Poker.
The number of players in the tournament, run by Harrah's Entertainment Inc. (HET), has ballooned thanks largely to the online game. In 2003, a mere 839 participants took part when accountant Chris Moneymaker emerged from a $40 Internet tournament and went on to win the $2.5 million grand prize. This year, 8,773 players gambled for part of an $82.5 million prize pool and more than half are estimated to have won tournaments over the Web to play.
With the law banning banks from processing Internet gambling transfers set to be enforced before next year's tournament, the well of poker players is expected to dry up.
"It's going to affect the average player most dramatically. And those players are the ones that have kind of filled the ranks," said Michael Bolcerek, president of the Poker Players Alliance, a 130,000-member group that fought the legislation.
"The hardcore ones will find somewhere, they won't care whether it's regulated," said Bolcerek. "That's what a prohibition does. It drives everything underground."
Mike Sexton, who hosts the popular World Poker Tour on the Travel Channel, said the ban would hurt what has become considered a sport.
"I wouldn't say it would put poker in a death spiral but in the long run it will hurt the growth of poker," Sexton said. "The World Series of Poker is going to be devastated over this."
Casino operators, however, were holding out hope.
"Poker's enormous popularity won't be changed," said Alan Feldman, spokesman for MGM Mirage Inc.
The number of poker tables in Las Vegas has surged from 142 in 2003 to 405 in 2006, with many citing the growth to Internet players seeking to test their skills on the felt.
Organizers for the World Series of Poker, televised by Walt Disney Co.'s ESPN, also said they were not daunted by the new law. Before the legislation was enacted, ESPN, which has covered the tournament since 1993, signed on to cover it through 2010.
Tournament spokesman Gary Thompson said since 2005, organizers have not accepted third-party registrations for the $10,000 buy-in main event from online gambling companies with U.S. operations, and that hasn't stopped it from attracting record fields.
"In 2005 and 2006 we had record fields each year. We're confident again that 2007 will be the best one ever," he said.
Thompson suggested that a loophole that allowed players who qualified online to pay their own entry fees directly, after being given the fees by online poker companies, would continue to pass muster with regulators.
PokerStars.com said it paid the way for 1,600 players who qualified online this year, while Bodog.com said it sent more than 500.
"We're planning to accommodate a larger field than we ever had before," Thompson said. "But whether or not we'll have a larger field, nobody really knows."
Experts-Ban Won't Stop Online Gambling
"The regulations are clearly going to prevent banks from doing electronic fund transfers to gambling sites, but that is no big deal," Rose said.
Clamping down on the banks won't serve as a panacea, Rose said. In some cases, banks simply move the money to payment processors, known as e-wallets. Non-U.S. payment processors such as the widely used Neteller then transfer the money to the Internet gambling sites.
The U.S. government has no authority over processors like Neteller that are operating legally.
Anthony Cabot, a well-known gambling lawyer in Las Vegas, thinks language used in the bill provides a loophole for the payment processors and the U.S. banks that want to be free to do business with them.

Hey Man, Where Is The Snake?
There's no dashboard warning light for this...
BERLIN (Reuters) - A German car rental clerk had to take apart the interior of a removals van to take out an eight-foot boa constrictor that had escaped from a cloth sack on the passenger seat and slithered behind the dashboard.
Thomas Weber, a rental clerk in the state of Thuringia, told Bild newspaper Friday the snake's owner had brought the van back seeking help for his unusual problem. Weber then took the dashboard apart and the owner slowly pulled the giant snake out.
"The snake was completely content in there and didn't want to come out," said Weber. "Evidently, he liked the warm and cozy feeling near the engine."
Yeah, I love the animals, but, I will pass on the NO LEG critters! Especially if they are 8 feet long!

Sony Shows Off PlayStation 3, New Games
(AP) - As the countdown to its Nov. 17 U.S. launch neared, Sony Corp. (SNE) showed off its PlayStation 3 game console Thursday and named 22 titles that will be available at the same time.
The games at launch will run the genre gamut, from racing and war games to updated, more powerful versions of popular sports titles - "the most robust game lineup" of any new-generation game system, boasted Kaz Hirai, president and chief executive of Sony Computer Entertainment America.
Sony's own in-house developed titles, such as a first-person shooting game called "Resistance: Fall of Man" will be $59.99.
Other games that will be available for download directly onto the PS3 will be priced at $14.99 or less, Sony officials said.
Prices of certain accessories also were disclosed: $50 for an extra wireless controller; $15 for a memory card adapter; and $25 for a remote control for the system's built-in Blu-ray disc drive player.
The console is already the most expensive among the new generation of game systems with a price tag of $500 or $600, depending on the model, but analysts say Sony's dominance in the video game market still will dictate its success.
Sony has sold 106 million PlayStation systems globally, including 40 million of them in the U.S., while Nintendo Co. has sold roughly 21 million GameCubes, and Microsoft Corp. (MSFT) has sold about 23 million Xbox systems, said P.J. McNealy, an analyst at American Technology Research.
"At the end of the day, Sony still has tremendous brand loyalty here, and they'll sell millions," he said.
Sony officials were equally optimistic.
"We've always had formidable competition," Jack Tretton, executive vice president of Sony Computer Entertainment America, said in an interview.
Introducing a product this time as a market leader seems less daunting than the challenge he faced when helping to launch the first PlayStation against the then-industry kings, Nintendo and Sega, Tretton said.
Don't know about you, but, I am getting pumped for the new system.

Playstation Vid Game-Scarface:The World Is Yours
Robert Workman's One-Minute ReviewRadical and Vivendi took a big risk with the 'Scarface' license, fiddling with film history in the same way EA did with the 'Godfather' license. However, this game seems to connect better than Coppola's property, due to the fact you control THE Tony Montana as he rebuilds his cocaine-fueled empire. There are flaws with the Heat meter and Balls system (yes, Balls system), and the graphic engine could've used some more polishing, but the game has hours of entertaining chaos to spare, and it nails down the movie's atmosphere and Tony's attitude perfectly. Drop down a $50 and say hello to your new little friend.

Monster Marijuana Plants, Smoke This
Troops battle 10-foot marijuana plants
OTTAWA (Reuters) - Canadian troops fighting Taliban militants in Afghanistan have stumbled across an unexpected and potent enemy -- almost impenetrable forests of 10-feet-high marijuana plants.
General Rick Hillier, chief of the Canadian defense staff, said on Thursday that Taliban fighters were using the forests as cover. In response, the crew of at least one armored car had camouflaged their vehicle with marijuana.
"The challenge is that marijuana plants absorb energy, heat very readily. It's very difficult to penetrate with thermal devices ... and as a result you really have to be careful that the Taliban don't dodge in and out of those marijuana forests," he said in a speech in Ottawa.
"We tried burning them with white phosphorous -- it didn't work. We tried burning them with diesel -- it didn't work. The plants are so full of water right now ... that we simply couldn't burn them," he said.
Even successful incineration had its drawbacks.
"A couple of brown plants on the edges of some of those (forests) did catch on fire. But a section of soldiers that was downwind from that had some ill effects and decided that was probably not the right course of action," Hillier said dryly.
One soldier told him later: "Sir, three years ago before I joined the army, I never thought I'd say 'That damn marijuana'."
Yeah, right. This soldier was probably saying, "damn, look at the size of this herb", ain't nobody back home gonna believe this". "One of these plants will do us for a year or more". "The hell with the Taliban, start digging this stuff up".
Can you imagine? A 10' herb plant. There aren't enough snacks to handle the "munchies" these plants would produce. That's the problem.

Tech Update: "Second Life & Google"
Sun Hosts News Conference in Second Life
SAN FRANCISCO (AP) - Sun Microsystems Inc. (SUNW) spared the stodgy PowerPoint slides when it announced its new gaming strategy. Instead, 60 journalists, analysts and product developers from around the world sent their virtual proxies - known as avatars - to a simulated world on the Internet.
The event, hosted by the avatar of Sun Chief Researcher John Gage and held on an island in the online game "Second Life," was billed as the first news conference by a Fortune 500 company in the game.
"Second Life" is a subscription-based 3-D fantasy world devoted to capitalism - a 21st century version of Monopoly that generates real money for successful players. More than 885,000 people have avatars who interact with one another in the virtual world.
"We've been trapped inside the text world for so long," Gage said. "It's time for us all to get more Second Lifey."
Santa Clara-based Sun, which develops hardware and software for corporate networks and for gaming servers, hopes its "Second Life" outpost will become a destination for 4 million people worldwide who help write Sun's open-source code. No more than 22,000 can make it to Sun's annual physical gathering in San Francisco.
"We'll have bean bag chairs, and it will be a great place for people to try out code," Gage's avatar said on an outdoor stage flanked by billowing trees and ocean. "We want it to be just like your local neighborhood."
Brands such as Toyota Motor Corp. (TM)'s Scion, Intel Corp. (INTC), CNet Networks Inc., Advance Publications Inc.'s Wired magazine, Adidas AG and American Apparel Inc. have already been building "Second Life" outposts. In August, former Virginia Gov. Mark Warner became the first real-world politician to host a "Second Life" town hall meeting.
"What corporate presence within 'Second Life' allows for is a different type of immersion in the product," said Donald Jones, Georgetown University graduate student writing his thesis on "Second Life.""It provides the corporation with an opportunity to seem like they're cutting edge. It helps them sell their image and their lifestyle within cyberspace."
Sun's virtual news conference Tuesday wasn't entirely glitch-free. The avatar of Philip Rosedale, Linden Lab's founder and CEO, briefly appeared on stage naked because of a software bug.
Google Offering Free Software Package
MOUNTAIN VIEW, Calif. (AP) - Google Inc. (GOOG) is making its word processing and spreadsheet programs available for free to all comers on its Web site, marking the Internet search leader's latest effort to provide an alternative to Microsoft Corp. (MSFT)'s dominant software applications.
The software package, expected to be available Wednesday, combines a spreadsheet application that Google introduced in June with a word processing program called Writely that the Mountain View-based company bought for an undisclosed amount in March.
As part of the expansion, the Writely name will disappear. The new package will be called Google Docs & Spreadsheets.
Google also had been limiting usage of both the word processing and spreadsheet programs, but the company now expects to be able to accommodate anyone who signs up, said product manager Jonathan Rochelle.
Wednesday's move continues Google's attempt to assemble a suite of software applications that are tethered to an Internet connection instead of a single computer's hard drive. That makes it easier for people to work on the same document from different locations, a convenience that is also meant to encourage more sharing among users with common interests or goals.

Your Life Suck? Try A "Second Life"

'Second Life' 3-D Digital World Grows
AMSTERDAM, Netherlands (AP) - In the beginning, Philip Rosedale created a virtual heaven and a digital earth, and then he said "let there be 'Second Life.'"
Whether or not it's good, the 38-year-old entrepreneur's 3-D world is certainly fruitful and multiplying.
"Second Life" now has more than 800,000 denizens, of whom more than a hundred are earning a real-world, full-time living there, selling things like virtual land, clothes, jewelry, weaponry and pets, or by offering virtual services, notably sex.
Yes, people pay real money for things they can only use in Rosedale's world, which is created on powerful servers and accessed through the Internet. Hundreds of thousands of real dollars change hands in "Second Life" daily, and it would have an annual gross domestic product of around $150 million if it were to stop growing today.
But Rosedale forecasts it will pass a million users this year. A rush to be part of the "new new thing" is on, and organizations like Major League Baseball, Harvard University, American Apparel Inc., and CNet.com are among the many opening operations in "Second Life," while musicians like Duran Duran and Suzanne Vega have broadcast virtual concerts there using the world's lifelike animated characters.
As chief executive of Linden Research Inc., which owns "Second Life," Rosedale is akin to the world's god, with the software code he approves determining its fundamental laws. But when he enters "Second Life" as his self-created avatar, or character, he claims no special power other than celebrity above the thousands of other intelligent designers who populate its realms.
"I have to admit that I'm vain, like all of us. Nowadays to be Philip Linden (his online alter ego) is to be a rock star," he told The Associated Press in an interview at a recent conference.
But "if I were the king, then this couldn't be what it is," he says.
Whatever "Second Life" is, it's clear that it belongs in a different class than the virtual realities of film and fiction that have gone before it.
The closest comparison would be to online video games like "World of Warcraft," or "The Sims Online." Users download free software that opens a portal to "Second Life," and Linden's servers draft models of the ever-changing world and send it back to them as a real-time video.
The difference is, Rosedale's creation "is not a game," he said. It doesn't have a goal, and most resources aren't restricted. Characters can fly or breathe water, and they never age or die.
Like in real life, it's up to you what you do in "Second Life," and many are flocking to it with dreams of getting rich quick. Anshe Chung, the character created by Chinese-German businesswoman Ailin Graef, reportedly netted more than $100,000 last year trading and leasing land in desirable "Second Life" locations.
Land is the one resource that is limited, and the main source of revenue for Linden. Users who want a permanent place in the world to build their virtual homes or set up businesses pay $10 a month to own 500 virtual square meters, or an eighth of an acre, in addition to the one-time cost of purchasing developed real estate from speculators like Graef or virgin land from Linden.
Linden also takes in commissions from operating "Second Life's" currency exchange. "Linden dollars" trade at a fluctuating rate against the U.S dollar - right now it's about US$1 to L$280.
Another big draw for "Second Life" is the prospect of witnessing or engaging in virtual sex. Players can alter their characters' appearance to be as beautiful or sexy as their imaginations - and computer graphics - allow them to be.
Rosedale says he did intend "Second Life" to be a kind of marketplace, but not necessarily a brothel. "The generative idea was that it was a place where you could create things," he says.
Users own the intellectual property rights to the things they design there. That has attracted tech-savvy designers who craft landscapes of stunning beauty and build objects of infinite cunning.
Rosedale describes a recent invention that caught his eye: virtual glasses that, when worn, allow players who don't speak the same language to communicate.
"It's magical," he says, "to have someone type Japanese (characters) to you and then, blip, words" appear on your screen.
Rosedale says scholars and companies are using "Second Life" to model real-world problems, like the logistics of distributing aid after a disaster, or studying how efficient the layout of a proposed office building will be.
Of course, "Second Life" is hardly a Garden of Eden. One of its servers was hacked last month, potentially exposing users' personal data, and in-game harassment is a common problem. On "Second Life's" Web site there's a "police blotter" of disciplinary action taken against users for various violations of the world's commonsense code of conduct.
Rosedale says there are no court cases that he's aware of yet but he concedes a lawsuit over in-game copyright infringement can't be far off.
Rosedale describes himself as a bookish San Diego kid who liked electronics and power tools from an early age - he even modified his bedroom door to open upward with a garage opener.
He became interested in computer programming and founded his first company while still in high school. It was bought by RealNetworks Inc. (RNWK) in 1996 and Rosedale served as the company's chief technical officer. He left in 1999, when he realized high-speed Internet connections would soon make it possible to create the virtual world he had dreamed about for a decade.
"Second Life" was launched in 2003. It's grown to the size of a virtual San Francisco, where Linden is based, but its geography and cultural life are so rich and varied that the October issue of Wired Magazine contains a "Let's Go"-style sightseeing guide.
Rosedale says Linden is "almost" turning a profit. He owns a significant stake in the company, but doesn't control it. It's backed by well-known Silicon Valley venture capital firms.
Rosedale says he wouldn't have predicted many things about the direction users have taken the world.
"I thought that when you came into 'Second Life,' you'd see, like, 'space port Alpha' ... a wild mishmash of future visions," he says.
In fact, there are many futuristic landscapes and cyber-punk characters. But advertisements are everywhere, and much of the world's residential property looks like Malibu - a reflection of people's earthly desires.
"They want oceanfront property ... and they want palm trees, and they want a cantilevered Frank Lloyd Wright house, up a little bit from a beach at a pier with a little power boat ... And then they watch the sun set on the deck," he says.

Music, Myspace & Life
If you are, or were, cruising through life as I was, then you really need to check this out.
Yeah, I was just like you. Accept and believe all the "garbage" that I was being force fed by the "so called public/commercial media. Print, radio, television. All the corporate commercial media whores of the world. If you were like most people, you probably thought the only kind of music available these days was " ignorant, sound alike rap and loud or lame NO TALENT rock/pop"! That is pretty much all that is offered by traditional media. Hey, these "whore" media outlets have to appease their pimp music companies desires.
However, there are plenty emerging outlets to hear and find all of the other "good stuff" that is going on in the world musically. There are artist out here that far surpass anything on commercial radio today. There is music out here that totally negates the crap being pushed on us by corporate commercial media. A couple of great places to experience some of this great stuff are "the internet" and "satellite radio".
The best venue for a totally all encompassing and satisfying music experience today though, is MySpace! That's right, the same place that gets all the "negative" media attention. Because "they" don't want you there. They are afraid you will discover what I have. That you really do not need "corporate commercial media". In the 2 plus months that I have had a myspace profile, I have discovered some of the most amazing artist and music in the world. AND, I have actually been able to interact with some of them to really get into their music and souls. It's incredible! It's free! It's a door to a better mind expanding life!
